Landmark cases: Richter v Minister of Home Affairs

right-to-vote
The right to vote is symbolic of our citizenship...

Without voters who want to vote, who will take the trouble to register and to stand in queues, as millions patiently and unforgettably did in April 1994, democracy itself will be imperilled.

Each vote strengthens and invigorates our democracy.”
— Justice O'Regan

Happy New Year!

Our New Year's Resolution for 2019 is simple: we want to share with you some of the important judgments and statutes that have shaped South Africa.

It's an election year, so we thought we'll start with a judgment dealing with your right to vote, namely Richter v the Minister of Home Affairs. It deals with your right to vote and, specifically, your right to vote even when you are temporarily outside of South Africa.

Reading a 50-page judgment is probably not how you would like to start 2019, but at the very least, we urge you to check whether you are registered to vote.

The final voter registration weekend will take place on the weekend of 26-27 January 2019. Don’t miss it.

National Wills Week 2017

WillsWeek

Let's be honest... nobody likes to talk about death.

It is, however, of crucial importance that people plan for the time of their passing. By having a written and properly executed will and testament, you can have peace of mind that:

  • Your assets will be distributed to your family, friends, and other heirs according to your wishes;

  • Your minor children will be placed in the care and guardianship of people you trust and that your assets will be used to take care of your children's needs throughout their childhood and beyond;

  • An executor of your choosing will be appointed to administer your estate.

National Wills Week is an initiative spearheaded by the Law Society of South Africa. During this week (11 - 15 September 2017) participating attorneys across South Africa provide members of the public with a basic will for free. That's right... it's free, gratis, no strings attached legal services.

Additionally, and even though National Wills Week only applies to basic wills, our office will also draft more complex wills (such as those containing testamentary trusts) at a discounted rate during this week.

All you have to do is contact our office to arrange a suitable time for a consultation. If you're based elsewhere in the country, click on the link below to find a participating attorney near where you live.

Mandela Day 2017

Madiba is no longer with us, but we can still celebrate his birthday in a way that makes a positive difference in the communities where we live. Cape Town's cold and wet winters take a toll on all us, but the homeless people of Cape Town are particularly vulnerable during this time of the year,  as they have little or any protection from the elements.

We've, therefore, decided to support a local organisation, named Street Sleeper, for this year's Mandela Day. They describe their main objectives as:

  • To provide immediate relief to South Africa’s homeless by manufacturing and distributing upcycled, durable survival sleeping bags;

  • To promote skills development amongst marginalised members of our society by providing employment; and

  • To lower social barriers and tackle the stigma around homelessness by facilitating dialogue and active engagement between the gifters and receivers of their bags.

There are various ways in which you can support them, so go check out their website by clicking on the link. We've decided to donate some funds to assist with the production of a few of their upcycled sleeping bags and we encourage all our clients and friends to do the same.

So get out there and do something good!
